A VICTORY FOR THE CONSTITUTION

The Tenth Amendment to our Constitution is perhaps the most ignored part of this document. This amendment, part of our Bill of Rights, in essence states that all powers not specifically delegated to the national government belongs to the states and the people if not already prohibited.

In the context of the recent Supreme Court decision on Roe v. Wade and Casey v. Mississippi the Supreme Court was restoring a constitutional right to the states and people taken away by the Supreme Court in 1973. In other words, the Roe decision, according to diverse jurists such as Ruth Baden Ginsburg and Clarence Thomas, was poorly decided and weak. Abortion cannot be something to be decided by the national government, it is to be decided on by the states and their people. So, for 49 years, we the people were denied a right constitutionally guaranteed to us.

So, anti-constitution hustlers like Schumer, Pelosi, AOC, and the “talking heads” on The View, CNN, and MSNBC are wrong- people were not denied a right last Friday, June 24, we won back a right. We live in a constitutional republic, not a democracy. (Oh yes, for a list of constitutionally granted powers to the national government, see Article I, Section 8.)

  1. My dear brother wrote in his blog recently about the overturning of Roe v Wade as a victory for the US Constitution. He cited the Tenth Amendment to the US Constitution as having a victory in that the individual states will now once again control abortion.

Okay fine, but now how about The 2nd amendment in that all people will not have the ability to keep and bear arms which is routinely abridged in many states and cities and the Supreme Court denies a person to bear arms. I actually think keeping and bearing arms shouldn’t be a right, unlicensed driving of personal vehicles should be a right for properly trained people, a home to live in comfortably should be a right with no governmental entity being allowed to take it for any reason, proper food and healthcare as well as education should be rights; keeping and bearing arms should be a licensed and controlled privilege. A living wage that allows all citizens to be comfortable should be a right; the dignity of each person must be a right.

Rights should be for living extant people from birth to grave.

Also, Amendment 4 is routinely violated with impunity by local state and federal authorities. I would also argue that the 9th amendment is so trampled upon as to make people wonder what the hell it even means.

And the 10th says right of the people as well as the state. All lawmakers seem to forget or nullify right retained by people. But the Supreme Court nullifies so many rights as to make peoples’ heads spin.

I understand what my dear brother writes and by and for itself as a stand alone it is a good thing. I am pro-life. I am also pro-life for living humans and some animals that seem to be sentient. But we live in an imperfect world and our rights based upon how many times they do get abridged proves that. We should not carve out our favorites and pretend we have done something wonderful and great.

The recent SP overturning Roe v Wade was just a social engineering coup in favor of religious fundamentalists, it is a tool to control people once more. It reflects the paucity of love from the minds and hearts of our "betters" and certain religious types that think they are better.
